The younger age band has the harsher impact test
Counterintuitive and worth knowing. Use and abuse testing is split by age: one set of procedures and forces simulates children up to eighteen months, another simulates eighteen to thirty-six months, and where a product’s intended age spans both, it must be tested to the stricter of the two. CPSC give an example, and it runs against instinct: the impact test is more stringent in the younger band. On reflection it makes sense, since an infant drops everything repeatedly from height and has no concept of a toy being breakable, while a three-year-old has some. But it means the toughest handling a toy is tested against is not necessarily from the oldest child who will use it.
The manufacturer does not simply get to pick the age
Important because it is what stops the label being marketing. CPSC list the factors used to determine whether a product is intended for children under three, and the first includes the manufacturer’s stated intent along with whether that intent is reasonable, giving the age stated on a label as the example. Advertising, promotion and marketing are also weighed. So a company cannot avoid the under-three rules by printing a higher number on a product that is plainly for babies. The age grade is a constrained claim rather than a free one, which is a large part of why it can be relied on for what it does say.
Three hazards, three different age bands, and balloons are the outlier
Worth knowing because it tells you where the regulator drew each line and the differences are large. Warning labels are required for small parts in toys intended for children aged three to six. What it cannot do is keep the pieces on one side of the room. Alongside that, two things worth doing with used toys: older plastic can become brittle and break into small sharp pieces, so inspect it rather than assuming it is the same product it was twenty years ago, and check the CPSC recall database before bringing secondhand toys into the house.
