These Terms of Use (“Terms”) govern your access to and use of installers.org and any related pages, features, and services (the “Service”), operated by Niche Leads, LLC(“we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Installers.org Is
Installers.org is an online directory and referral service that helps consumers find independent, third-party assembly and installation service providers (“Providers”) in their area, and helps connect consumers with those Providers: including by collecting a request from you and forwarding it to one or more Providers so they can offer a quote.
We are not a Provider. We do not perform assembly, installation, repair, or any other service listed on the Service. We are not a party to, and are not responsible for, any agreement, communication, transaction, payment, or dispute between you and a Provider. No agency, partnership, employment, joint venture, or franchise relationship is created between us and any Provider or user. Providers are independent businesses that operate on their own behalf.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent that you meet these requirements and that the information you provide is accurate.
3. Quote Requests and Contacting Providers
When you submit a quote request, contact form, or otherwise ask to be connected with a Provider, you authorize and instruct us to share the information in your request: such as your name, contact details, ZIP code or location, and the project details you provide , with one or more Providers so they can contact you and attempt to fulfill your request. A single request may be shared with multiple Providers at once.
Providers are independent third parties. We do not guarantee that any Provider will respond, that you will receive a quote, or that any quote, price, timeline, or service will be available, accurate, or satisfactory. How a Provider uses your information after we share it is governed by that Provider’s own practices, which we do not control. 4. Provider Listings; Removal at Our Discretion
- We may list, decline to list, edit, reorder, suspend, or remove any Provider listing at any time, in our sole discretion, with or without notice and with or without cause. We may also decline or terminate participation in paid or featured placements.
- Inclusion of a Provider is not an endorsement, certification, or guarantee. Unless we expressly state otherwise, we do not independently verify a Provider’s licensing, insurance, qualifications, background, or the accuracy of its listing.
- You are responsible for evaluating any Provider before hiring them, including confirming their licensing, insurance, references, and suitability for your project.
5. For Providers
If you claim, submit, or maintain a listing as a Provider, you represent that you are authorized to act for the business, that your information is accurate and kept current, and that you hold any licenses, permits, and insurance required for the services you offer. You are solely responsible for the services you provide and your dealings with customers. You grant us a non-exclusive license to display your listing information on the Service, and you acknowledge we may modify or remove your listing as described in Section 4.
6. No Endorsement; Your Responsibility
Any agreement you enter into with a Provider, and any payment, scheduling, performance, warranty, or dispute, is solely between you and the Provider. We do not supervise, direct, or control Providers and make no representations about the quality, safety, legality, or timeliness of any Provider’s work. You agree to raise any service dispute directly with the Provider.
6a. Consent to Be Contacted
When you submit a quote request, you agree that Providers may contact you at the phone number and email address you supply, about that request, including by telephone call, text message (SMS), and email, and including through automated or prerecorded means. Message and data rates may apply. Consent to receive marketing calls or texts is not a condition of purchasing any goods or services.
This consent extends to contact concerning the request you submitted. A Provider may not add you to a general marketing list, send you unrelated offers, or continue to contact you after you have asked it to stop. You may withdraw this consent at any time by instructing the Provider directly, by replying STOP to a text message from that Provider, or by contacting us at privacy@installers.org. Withdrawal is prospective only: it does not undo contact already made. Withdrawal communicated to us prevents further disclosure of your information by us, but a Provider that has already received your request holds its own records, and a withdrawal directed to one Provider does not bind another.
6b. Provider Use of Customer Information
Providers receive the names, telephone numbers, addresses, and project details of identifiable individuals. If you are a Provider, such information is disclosed to you for a single, limited purpose: responding to the specific request with which it was provided. You agree that you shall not:
- sell, rent, license, share, or otherwise redistribute customer information to anyone;
- add a customer to a marketing list, newsletter, or campaign they did not ask for;
- use customer information for any purpose other than responding to that request;
- contact a customer after they have asked you to stop, or in violation of the Telephone Consumer Protection Act, state telemarketing law, or the CAN-SPAM Act;
- retain customer information longer than you need it for that request and your own legal or tax record-keeping.
The obligations in this Section survive termination of your listing and of these Terms. Breach of this Section constitutes grounds for immediate removal from the Service without refund, and you shall indemnify us in accordance with Section 12 in respect of any claim arising from your misuse of customer information.
6c. Partners (Brands and Retailers)
A “Partner” is a business that uses our API, partner dashboard, or embeddable installer finder (“Embed”) to reach Providers. If you are a Partner, this section applies to you in addition to the rest of these Terms.
- Customer information you send us. When you post a job, you supply your own customer’s name, contact details, and address, and we pass it to Providers so the work can be done. You represent that you have the authority and any consent required to share that information with us and with Providers for that purpose, that your own privacy notice permits it, and that the customer has consented to be contacted about the job. You are responsible for the accuracy of what you send, and you indemnify us for claims arising from information you had no right to share.
- API keys and credentials. You must maintain the confidentiality of your API keys and credentials. You are responsible for all activity conducted under your credentials, whether or not you authorized it. You may not embed a secret API key in a web page, mobile application, or any other medium accessible to a third party. You must notify us promptly upon becoming aware that a key has been disclosed or compromised, and you may rotate your keys from the partner dashboard at any time.
- The Embed. We grant you a revocable, non-exclusive, non-transferable license to display the Embed on the domains you register with us, for as long as your subscription is active. You may not modify it to misrepresent what it is, remove the disclaimers, or present Providers as your employees, agents, or as vetted or endorsed by you or by us.
- No harvesting. Provider information reached through the Embed or the API is licensed to you for the purpose of connecting your customers with Providers. You may not scrape, bulk-extract, cache beyond operational need, republish, sell, or build a competing directory from it, and you may not use it to solicit Providers away from the Service. This survives termination.
- Rate limits. We may impose and change rate limits, and may suspend credentials that place an unreasonable load on the Service or that we reasonably believe are being misused.
6d. Payments Between Partners and Providers
We may make available a means for a Partner to pay a Provider by card. If you use it, you are paying the Provider directly. The payment is processed by Stripe on the Provider’s own connected Stripe account. The Provider is the merchant of record for that payment, not us.
- We do not hold, escrow, or take any share of the payment. The charge will appear on the payer’s card statement under the Provider’s business name and not under ours.
- Refunds, adjustments, chargebacks, and disputes about the work or the amount are between the Partner and the Provider. We are not a party to them and cannot reverse a payment. Chargeback liability sits with the Provider as merchant of record.
- Any price shown, including any adjustments a Partner enters, reflects what those two parties agreed. We do not set, verify, or guarantee it.
- Your use of Stripe is also subject to Stripe’s own terms. Card details are handled by Stripe; we never receive them.
6e. Subscriptions, Paid Placement, and Lead Purchases
- Paid plans and Partner subscriptions renew automatically for the same period until cancelled. You may cancel at any time, effective at the end of the current billing period. Fees already paid are not refundable except where required by law or where we choose otherwise.
- Paid placement affects position and prominence. It is not a warranty that any Provider is better, more qualified, licensed, insured, or suitable, and it is not an endorsement.
- Where a Provider purchases access to a lead, the fee buys the opportunity to contact that person. It is not a guarantee that the person will respond, will not have already hired someone else, or will do business with you. Leads are sold as-is, and are non-refundable except at our discretion.
- We may change prices on notice, effective at the next billing period.
6f. Photos, Messages, and Content You Upload
Providers may upload photographs of completed work, and Providers, Partners, and customers may exchange messages through the Service. If you upload or send content:
- You represent that you have the right to do so, and that you have the permission of the property owner before photographing the inside of someone’s home or any identifiable private property.
- Do not upload images of identifiable people, children, faces, documents, or anything else that identifies a person, without their consent.
- You grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt, and publicly display that content for the purpose of operating and promoting the Service, including displaying it to the other parties on that job and using it in marketing, advertising, and on public pages of the Service. You retain ownership of your content.
- Limits on our promotional use, which bind us and not only you. We will not publish a photograph in marketing where it identifies a customer, a household, or a street address. We will not represent that a Provider is affiliated with, endorsed by, or acting on behalf of any product manufacturer or brand. A Provider may withdraw a photograph from promotional use at any time by writing to legal@installers.org, and we will remove it from public pages within a reasonable period, save for copies already distributed.
- The permission you must already hold. The promotional license above is granted by you and depends on your having the right to grant it. Before photographing completed work, you must have the property owner’s consent to the photograph being taken and to its use in this way. You may not upload a photograph you are not entitled to license to us, and Section 12 applies to any claim arising from your doing so.
- Messages sent through the Service are not private between you and the other party alone: we store them, and we may review them to investigate abuse, resolve a dispute, or comply with law. Do not send payment card numbers, government identifiers, or other sensitive information through them.
7. Acceptable Use
You agree not to:
- submit false, misleading, or fraudulent information, or impersonate any person or business;
- use the Service or any contact information obtained through it for spam, harassment, or any unlawful or unsolicited marketing purpose;
- scrape, harvest, copy, or systematically extract data or listings from the Service;
- interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems; or
- use the Service in violation of any applicable law or regulation;
- use automated means to access the Service, or attempt to enumerate Providers, customers, jobs, or ZIP codes, whether through the website, the Embed, or the API;
- circumvent, disable, or interfere with any rate limit, allowlist, authentication, or other protection we put in place; or
- use the Service to build, train, or improve a competing directory, marketplace, or dataset, including by using it as input to a machine learning system.
7a. Suspension and Termination
We may suspend or terminate any account, listing, subscription, credential, or Embed license at any time, with or without notice, if we reasonably believe there has been a breach of these Terms, a risk to customers, Providers, or Partners, a legal or regulatory problem, or misuse of customer information. Where the breach involves the misuse of customer information, we may act immediately and without refund.
You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including Sections 6b (Provider Use of Customer Information), 6c (no harvesting), 6d (payments), 8, 10, 11, 12, and 14.
8. Intellectual Property
The Service, including its design, text, graphics, logos, and software, is owned by Niche Leads, LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive license to access and use the Service for its intended purpose. You may not copy, reproduce, distribute, or create derivative works from the Service without our prior written permission.
9. Third-Party Links and Content
The Service may contain links to or information from third parties, including Providers. We are not responsible for third-party websites, content, products, or practices, and accessing them is at your own risk.
9a. Installation Guides and Reference Content
The Service publishes written guides about assembling and installing particular products and brands (“Guides”). Guides are general reference material intended to help you understand what a job involves and decide whether to hire a Provider. They are not assembly instructions and are not a substitute for the documentation supplied with your product.
Always follow the manufacturer’s manual. Where anything in a Guide differs from the instructions, specifications, warnings, or safety information supplied by the manufacturer or retailer, the manufacturer’s documentation controls. Specifications vary by model, model year, region, and revision, and figures such as weights, capacities, torque values, dimensions, clearances, and electrical requirements should be confirmed against the documentation for your specific product before you rely on them.
Some work described in Guides is regulated or hazardous, including electrical, gas, plumbing, structural, and work at height. Such work may require a licensed professional, a permit, or an inspection in your jurisdiction. Nothing in a Guide is professional, legal, or engineering advice, and you are responsible for complying with applicable law and codes.
Guides are researched and produced with the assistance of artificial intelligence under human direction and review, drawing on manufacturer documentation and other publicly available sources. Despite that review, Guides may contain errors, omissions, or information that has become outdated, and they are provided without warranty of accuracy or completeness. We are not affiliated with, endorsed by, or sponsored by the brands referenced, which are named only to identify the products a Provider may work on.
If you believe a Guide contains an error, please tell us at legal@installers.org so we can review and correct it.
9b. Reviews and Ratings
The Service displays customer reviews and aggregate ratings on Provider profile pages and in search results. These ratings are computed from multiple sources, which may include:
- Google reviews retrieved from the Google Places API and cached periodically;
- Partner reviews submitted by Partners who have worked with a Provider through the Service;
- Customer reviews submitted by end customers through the Service or imported from YesKandu.com, a predecessor platform that is no longer in operation. YesKandu reviews were left by verified customers of the same Providers and are attributed as "Verified Customer" reviews.
The overall rating displayed for a Provider is a weighted average of all available review sources, calculated by combining the total number of reviews and their respective ratings across sources. We do not edit, alter, or selectively display reviews to favor or disadvantage any Provider, though we reserve the right to remove reviews that violate these Terms or that we reasonably believe are fraudulent, abusive, or spam.
Reviews reflect the subjective opinions of their authors. We do not verify the accuracy of review content and make no warranty that any review is truthful, complete, or current.
9c. Affiliate Links
Some links on the Service point to third-party products or services and may be affiliate links. This means we may earn a small commission if you click through and make a purchase or sign up, at no additional cost to you. Affiliate relationships do not influence which products or services we recommend, how Providers are ranked, or how jobs are assigned. We only link to tools and services we believe are genuinely useful to our users.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LISTING OR INFORMATION IS ACCURATE OR CURRENT.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NICHE LEADS, LLC AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM YOUR USE OF THE SERVICE, YOUR DEALINGS WITH ANY PROVIDER, OR ANY SERVICES PERFORMED OR NOT PERFORMED BY A PROVIDER. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
12. Indemnification
You agree to indemnify and hold harmless Niche Leads, LLC and its owners, officers, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your dealings with any Provider or user.
13. Changes to the Service and Terms
We may modify or discontinue the Service, and may update these Terms, at any time. Changes are effective when posted with an updated “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to the Service or these Terms will be resolved exclusively in the state or federal courts located in Kentucky, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us to attempt to resolve the matter informally.
15. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver. These Terms are the entire agreement between you and us regarding the Service.
